Pat’s mediation and arbitration practice is conducted exclusively through Henning Mediation & Arbitration Service, Inc.
Mediation:
In addition to his 16+ years of experience as a mediator, Pat was also involved in a number of mediations when he was the General Counsel of a public company, giving him the unique perspective of both a mediator and a party.
Arbitration:
Two of the generally recognized primary benefits of arbitration are that it is faster and less expensive than litigation, and Pat works hard as an arbitrator to realize those benefits.
Med-Arb:
Med-Arb is a hybrid ADR process in which the parties agree first to mediate a dispute, and then to arbitrate any unresolved issues. Pat has served as both the mediator and arbitrator in several med-arb situations, including one that involved a two-person professional services firm that was going through a business divorce.
ADR Consulting:
Pat has served as an ADR consultant in an arbitration involving a post-closing purchase price adjustment following the sale of a company for more than $100,000,000, which involved extremely complex accounting issues, and which resulted in a favorable price adjustment for Pat’s client.
Non-IRS Co-Mediator:
Pat is one of only a handful of people in the Southeast who has served as a Non-IRS Co-Mediator at the IRS Appeals level. A Co-Mediator must come from a local or national organization that provides a roster of neutrals, and he/she must have substantive knowledge of the tax law. In that case the mediation resulted in a significant decrease in the taxpayer’s proposed tax liability. Moreover, the taxpayer was able to avoid the substantial cost of filing a petition for redetermination with the United States Tax Court, or paying the proposed tax deficiency and filing a refund suit in the United States Federal District Court or the United States Court of Federal Claims.
